Petition for election of Punjab Chief Minister, Lahore High Court directed to file the petition for hearing today
The Chief Justice of the Lahore High Court dismissed the objection of the High Court office on the request of Hamza Shahbaz for the election of Punjab Chief Minister.
Opposition leader in the Punjab Assembly Hamza Shahbaz had filed a constitutional petition in the Lahore High Court for the election of the Chief Minister in which the Speaker, Deputy Speaker and IG Punjab have been made parties.
Position in the application
The petition states that the post of Chief Minister of Punjab is vacant and elections should be held as soon as possible.
The petition further said that Secretary Assembly and administrative officers were obeying the illegal orders of Pervez Elahi and there was unwarranted delay in convening a meeting of the Punjab Assembly.
The petition contends that the session of the Assembly cannot be adjourned under Article 130 of the Constitution until the election of the Chief Minister.
The petition states that the persons who have been made parties have failed in the discharge of their duties, therefore the court should issue an order soon and make the selection possible.
Objection of High Court Office
The Lahore High Court Office has objected to the petition of Hamza Shahbaz stating that the proceedings of the Assembly cannot be referred to the Lahore High Court under Article 69.
Hearing headed by Chief Justice
Lahore High Court Chief Justice Amir Bhatti heard the objection of the High Court office during which Hamza Shahbaz's lawyer Azam Nazir Tarar while giving arguments said that the Speaker himself is contesting the Chief Minister's election and the Deputy Speaker is doing constitutional work.
On this, the lawyer of the Deputy Speaker said that the Deputy Speaker was acting in accordance with the law. The Chief Justice asked who stopped him from convening the meeting.
Azam Nazir Tarar said in the court that there is no government in the province for 8 days, on which the Chief Justice asked, where have you been for 8 days?
Later, the court dismissed the objection of the Lahore High Court office on the application of Hamza Shahbaz and directed the office to post a number for hearing on the application.

During the hearing for the election of Chief Minister Punjab, the lawyer of Deputy Speaker Punjab Assembly Dost Mazari presented arguments.
Lawyer Deputy Speaker said that Pervez Elahi himself is the Chief Ministerial candidate. The Speaker cannot conduct this session as per the constitution.
The Deputy Speaker has the power under the constitution to run the House. Lawyer Hamza Shahbaz said that we were prevented from entering by installing barbed wire.
Punjab has been running without government for 8 days.
Important legal points have been raised in the petition. The AG had given assurance in the Supreme Court. The Lahore High Court adjourned the hearing for some time. It is believed that the Lahore High Court objected to the petition of PML-N leader Hamza Shahbaz.
It has been said that the orders of the Speaker cannot be challenged in the court. The proceedings of the Assembly under Article 69 cannot be referred to the Lahore High Court.
It may be recalled that the Leader of Opposition in the Punjab Assembly Hamza Shahbaz had filed a constitutional petition in this regard in the Lahore High Court in which the Speaker, Deputy Speaker and IG Punjab were made parties.
It is vacant that elections should be held as soon as possible. Secretary Assembly and administrative officers are obeying the illegal orders of Pervez Elahi and the Punjab Assembly is being delayed without any reason.
The petition filed by the Chief Ministerial candidate of the opposition parties took the position that the session of the Assembly could not be adjourned under Article 130 of the Constitution till the election of the Chief Minister.
The court should issue an order soon and make the election possible.
