The Lahore High Court ruled in favor of the land dispute which has been going on since the formation of Pakistan in 1947, where the petitioner failed to prove his position, due to which the court imposed a fine of Rs. 1 million on the petitioner.
According to private news channel, the land dispute at the time of establishment of Pakistan was decided by Justice Chaudhry Muhammad Iqbal of Lahore High Court on the application of Agha Muzammil. In his decision, the court imposed a fine of Rs. 1 million Failed to prove position.
In its written judgment, the court held that the petitioner took the position that the land was purchased from Anir Singh on July 7, 1947 but Anir Singh moved to India after the formation of Pakistan.
According to the court decision, the petitioner challenged the transfer of 362 kanals of land, while in 1952, the Deputy Commissioner issued a notification of the land, but the Revenue Record did not mention the purchase of large yaz by the petitioner.
It may be recalled that earlier the Lahore High Court had quashed a decision of the trial court and had given rights to the sisters who had been deprived of property for the last 37 years, for which the Lahore High Court had given the property as a gift from the brothers through fraud.
In the petition filed in the Lahore High Court, the petitioner had taken the position that the brothers had seized the inherited property as a gift with the forged signature of the father.
According to the decision of the court, the claimant is required to state the time, place and date of the gift. It is also necessary for the claimant to disclose the names of the witnesses in whose presence the gift was given.
He also remarked on the case and said that the revenue officer confirming the agreement was not presented as evidence, the agreement does not have the thumbprint of the father of the sisters and there is no signature.
The decision issued by the Lahore High Court said that according to the records, no effort was made to ensure the identity of these persons, the revenue officer did not even try to know the reasons, the Lahore High Court wrote in the decision that the daughters inherited The sons were given special benefits by depriving them of property. The revenue officer did not ask the daughters if there was any such agreement and they are aware of it.
According to the Lahore High Court, no specific reasons were given for such discrimination against the daughters. The legal position of the lower courts was completely ignored.
